What do lawsuits REALLY cost? Lawyer Explains
If you're considering filing a lawsuit, you need to know what it will cost you. You might be surprised to learn that lawsuits will cost you more than just money.

When you tell a lawyer that you want to sue someone, they’ll usually find a reason for you to file a lawsuit. I mean, what did you expect? You’re asking the vacuum cleaner salesman whether or not you need a vacuum!
This is a conversation that I have with every client. In fact, in every single Representation Agreement, I have clients acknowledge that, “the Firm has advised me that litigation in general is risky, can take a long time, can be very costly, and can be very frustrating.”
I’m not one to shy away from a good fight but let’s talk about why you actually SHOULDN’T file a lawsuit. If after hearing this list you’re still feeling litigious, I’ll tell you what your next steps are.
Lawsuits take a lot of time
When I tell you that lawsuits take a lot of time, I mean that lawsuits can take years. Here’s a recent example. Recently, we finished lawsuit that has been ongoing for over 5 years.
You might be thinking that 5 years of litigation isn’t too bad since you probably think that it’s the attorney doing most of the work. However, the time commitment isn’t just on the attorney. When you’re in litigation, there are depositions to sit for, interrogatories that have to be answered, and documents that must be produced.
It’s not just your deposition that you have to sit for, but also the depositions of each witness and the other parties to the case. Since you know what happened during the events that the lawsuit is based on, you’re in the best position to advise your attorney when the other parties or the witnesses begin changing their stories. You can point that out on the spot so your attorney can ask additional questions.
All of this time that you devote to the lawsuit means lost time that you could use doing one of your hobbies, time away from your family, and time off work. Speaking of time off work, lawsuits cost a lot of money.
Lawsuits cost a lot of money
Before we talk about attorney’s fees, let’s discuss the out of pocket expenses that go into a lawsuit:
Filing Fee = $350-$400
Process Server = $100
Transcript for Deposition = $500-900/ea
Subpoenas & Costs for Records = $100/ea
Just the out-of-pocket expenses alone, if you just take one deposition and only send a subpoena for one set of records, will run you $1,500.00. Now let’s talk about attorney’s fees.
Attorney’s fees will vary wildly by location. Big city lawyers charge anywhere from $700-$900 per hour, while small-town lawyers charge $200-$300 per hour. However, highly specialized attorneys and named partners at big law firms could have hourly rates as high as $1,500 per hour.
It isn’t just your attorney’s hourly rate that you need to be aware of though, but also the Paralegal’s hourly rate. A Paralegal’s hourly rate is also going to vary by location, but generally it is about one-third to one-half of the attorney’s hourly rate.
I don’t mean this in a bad way, but some clients are needy and require a lot of hand-holding. Attorneys don’t mind taking this extra time when they get paid by the hour. So, if you know you’re the type of person that needs a lot of extra attention, then you need to factor this into your anticipated costs of litigation.
These hourly costs may not apply if your attorney is being paid on a contingency basis, meaning they get paid if you get paid. However, attorneys only take those cases if there is a guarantee of recovery from the other side (like an insurance company in a car wreck case). If your attorney isn’t taking your case on a contingency basis, then you’re going to have to pony up some cash because all attorney’s fees are paid up front throughout the case. Attorneys don’t wait to see if they might get paid.
Remember earlier how we discussed your lost time off work? That’s lost income for all of those days that you’ll have to attend court, depositions, and strategy meetings that you’ll have to take into account. The monetary cost pales in comparison though to the emotional cost.
Lawsuits are emotionally draining
Lawsuits are emotional rollercoasters. There’s a lot of anxiety that goes with finding the right attorney, paying a significant deposit to hire that attorney, and filing of the Petition.

    Kind of gross advice but its not your fault. "Innocent unless proven guilty" was intended to be "you cant punish people until you have proven they deserve to be" not "you should always try to see what you can get away with, they might not be able to pin it on you". The judge sentencing a guy maximum for pleading guilty was also pretty gross too, sentence terms are supposed to be based on how long you think it will take to rehabilitate the person and the severity of their crime, not "you didnt listen to my instructions so Im going to punish you". But the second case just proves why you gotta follow the first, because justice in America is far from blind.

    You are guilty until proven innocent actually. Being held in jail on bond nonbond doesn’t matter. You still throw yourself at a court you don’t know anything about.

    Things are different on my jurisdiction. You take a guilty plea, and you MAY get 1/3 off your sentence The defendant may also ask for time to review the evidence against him And if he's a fist time offender, or there are other mitigating issues, he'll not get the Max I've never seen anyone get the max in my jurisdiction

    These kids know everything and some just need more coaxing. They are babies. They need encouragement and to be coddled. Men will always refuse to lose to females fair and square. That is the concluaion. If I had a pair I might be succeasful but I refuse to cower to the good ole boy club. I play along but not for long. I guess I got to act stupid to be acceoted and successful.

    Louisiana does not allow you to bring video into the court house. they do not want you to undermine the prosecution with facts. As a result, it's impossible for the working class, to do anything but negotiate, because you will not be able to defend yourself for less then $10,000 with a lawyer.

      A motor carrier is a person or business providing transportation of goods and/or people for compensation or in furtherance of its own commercial enterprise. So a motor carrier would include the likes of Greyhound Lines (bus company), United Van Lines (moving company), and FedEx (courier company). It would also include the divisions of companies that move goods from their warehouses to their stores using trucks they own, such as Walmart. You in your automobile going to the grocery store to do personal shopping or dropping off your kids at school are not a motor carrier. So nothing in federal law governing motor carriers applies to you.

    I once was excused from jury duty because of health concerns. I told my doctor that I received a summons to report for jury duty selection and my doctor wrote a letter for me to present to the courthouse. A few months later, I was moving out of state and received another notice to report for selection. I went to the courthouse and explained that I was moving out of state the day immediately after selection. They excused me for that one, too. In my home state, Ive never received a summons to report for jury duty selection. But when I lived in a different state for 4 years, I had the experiences I listed above. I just find it very interesting. My point is that if you have significant medical issues, you can be excused - as long as your doctor acknowledges that you have a compromised condition and is willing to write a letter for you.

    Jury duty is one of them main reasons people don't vote... I'm pretty sure I could get out of jury duty, just by wearing an NRA hat, and humming "Helter Skelter" with my eyes wide open... and I do vote, that's way more important than jury duty ! I might consider doing it just for the experience... but I'm retired, so it would be easier to do than working people... I did get a notification once, but the case was settled out of court, so they didn't need me... and it is good to live in a rural community, where crime isn't so bad !

    Okay well I've read my state constitution California if you actually read what a regulated militia is it is under the beck and call by the governor who appoints officers in the militia. There's also the unregulated regulated militia which are people who don't want to be at the beck and call, but still want to defend themselves can we be a little more specific.

    In a perfect world, people who are guilty will always be found guilty even if they plead not guilty. The evidence against them should always be incriminating enough or not at all. The system works. The faults are the result of the humans that run it.

    These kids forget what rookies they are when it comes to supervising. I supervised 42 plus their families. They cant even handle me 7-4pm weekdays and I am just one person. Thats what they get for power trippin and worrying too much about someone else other than themselves. They cant even afford their own tools but want to play industry god. Good riddance.
